These Terms of Use govern your access to and use of the MyPersonalities® website, app, and suite of associated programs (collectively, "the Program"). By accessing or using the Program in any way, you agree to be bound by these Terms of Use in full.

Please read these Terms of Use carefully before using the Program. If you do not agree with any part of these terms, you must not use the Program.

These Terms of Use should be read in conjunction with our Privacy Policy and Disclaimer, both of which form part of the agreement between you and us. All three documents are available at mypersonalities.com

1. About MyPersonalities®

MyPersonalities® is a self-directed personal growth and psychotherapy program developed by Russell Kennard, research psychotherapist, and owned and operated by Persona Role Dynamics Pty Limited, Queensland, Australia.

The Program is designed to help users explore, understand, and transform their own personality through a structured process of persona discovery, mapping, and self-directed therapeutic work.

MyPersonalities® is not a substitute for professional psychological, psychiatric, or medical care. Please read our Disclaimer carefully before using the Program, as it contains important information about who should and should not use the Program, and under what circumstances professional supervision is required.

2. Eligibility

By using the Program you represent and warrant that:

You are at least 18 years of age, or have the mental capacity of a person of at least 18 years of age
You have the legal capacity to enter into a binding agreement
Your use of the Program is not prohibited by any law applicable to you or in your location
You have read and understood our Disclaimer and agree to the conditions set out within it

The MyPersonalities® Program is not designed for use by minors. If you are under 18 years of age, you must not use the Program.

3. Your Account

3.1 Account Creation

To access the full features of the Program, you must create an account by providing a valid email address and creating a password. You agree to provide accurate, current, and complete information when creating your account and to keep that information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. You must notify us immediately at mypersonalitiesapp@gmail.comif you become aware of any unauthorised access to or use of your account.

We will not be liable for any loss or damage arising from your failure to keep your login credentials secure.

3.3 One Account Per User

Each account is for the personal use of a single individual. You may not share your account with another person or allow another person to access the Program through your account.

3.4 Account Termination by You

You may delete your account at any time through your account settings. Deleting your account will permanently remove all persona content, assessment results, and progress data you have created within the Program. This action cannot be undone. Any remaining subscription period will not be refunded upon voluntary account deletion.

3.5 Account Suspension or Termination by Us

We reserve the right to suspend, restrict, or terminate your account and access to the Program immediately, without prior notice or liability, if:

You breach any provision of these Terms of Use
You use the Program irresponsibly or in a manner inconsistent with the warnings and conditions set out in our Disclaimer
You fail to seek professional help as required under the conditions set out in our Disclaimer
You engage in any conduct that we determine, in our sole discretion, to be harmful, offensive, unlawful, or damaging to the Program, its users, or its reputation

We also reserve the right to remove, reclaim, or force forfeiture of any username that is offensive, violates intellectual property rights, or may mislead other users in relation to the Program.

4. Subscription and Payment

4.1 Free Trial

New users are entitled to a 14-day free trial of the full MyPersonalities® Program upon account creation. No payment is required to begin the free trial. At the end of the 14-day period, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial period expires.

4.2 Subscription

Full access to the MyPersonalities® Program requires a paid monthly subscription of $19.00 AUD per month (or such other amount as may be notified to you from time to time). Your subscription renews automatically each month until cancelled.

4.3 Payment Processing

All payments are processed securely by Stripe, a third-party payment gateway. By subscribing, you authorise Stripe to charge your nominated payment method the applicable subscription fee on a recurring monthly basis. Your payment details are handled entirely by Stripe and are not stored on our servers. Please refer to Stripe's Terms of Service and Privacy Policy at stripe.com for further information.

4.4 Free Trial Access

During the 14-day free trial period, you will have access to minimal features of the MyPersonalities® Program including MyPersonalities Persona creation (maximum 8 personas), Mindfulness and Emotional Intelligence assessments.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You will retain full access to the Program until that date. We do not offer partial refunds for unused portions of a billing period.

4.6 Price Changes

We reserve the right to change the subscription price at any time. We will provide you with at least 30 days written notice of any price change before it takes effect. Your continued use of the Program after the price change takes effect constitutes your acceptance of the new price. If you do not agree with a price change, you may cancel your subscription before it takes effect.

4.7 Refunds

All subscription fees are non-refundable except where required by Australian Consumer Law. If you believe you are entitled to a refund under Australian Consumer Law, please contact us at mypersonalitiesapp@gmail.com

5. Use of the Program

5.1 Permitted Use

You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the MyPersonalities® Program for your own personal, non-commercial purposes, subject to these Terms of Use.

5.2 Your Responsibility

You acknowledge and agree that:

You use the Program entirely at your own risk and discretion
You are solely responsible for all content you create, input, and store within the Program — including all persona names, descriptions, colours, and associated data
The Program is a tool for self-directed personal development and is not a substitute for professional therapy, medical advice, or crisis support
You have read and understood our Disclaimer and will seek professional support when required under the conditions set out within it
You will not use the Program as your sole means of therapy if you are experiencing any of the conditions described in our Disclaimer

5.3 Prohibited Conduct

You must not use the Program to:

Engage in any illegal conduct or activity
Defame, abuse, harass, stalk, threaten, or otherwise offend any person
Publish, distribute, transmit, or disseminate any material that is unlawful, obscene, defamatory, indecent, offensive, or otherwise inappropriate
Impersonate any person or entity or misrepresent your affiliation with any person or entity
Engage in any conduct that restricts or inhibits any other person's use or enjoyment of the Program
Use any exploit, automation software, hack, bot, or any software designed to modify, disrupt, overburden, or interfere with the Program
Use any unauthorised third-party software that accesses, intercepts, or otherwise collects information from or sends unauthorised information to the Program
Attempt to gain unauthorised access to any part of the Program, its servers, or any systems or networks connected to the Program
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Program
Use the Program in any way that could damage, disable, overburden, or impair its operation

6. Content You Create

6.1 Ownership of Your Content

All persona content, assessment responses, and data you create within the Program remain your own. We do not claim any ownership over content you create within the Program.

6.2 Our Use of Your Content

We will not use the content you create within the Program for any purpose other than providing the Program to you. We will not share, sell, or otherwise make your content available to third parties. Please refer to our Privacy Policy for full details of how your information is handled.

6.3 Accuracy of Content

We make no claims as to the validity, reliability, accuracy, or completeness of the data you gather and enter into the Program. The Program works from the information you provide — the quality and honesty of your self-reflection directly affects the value you receive from it. You should not act on the basis of anything contained in the Program without first obtaining professional advice specific to your circumstances where appropriate.

7. Intellectual Property

7.1 Our Intellectual Property

The MyPersonalities® Program — including its name, trademark, logo, methodology, content, design, software, processes, and all associated materials — is the intellectual property of Persona Role Dynamics Pty Limited and is protected by Australian and international intellectual property laws.

MyPersonalities® is a registered trademark of Persona Role Dynamics Pty Limited.

7.2 Restrictions

You may not, without our express written consent:

Copy, reproduce, distribute, publish, or transmit any part of the Program
Modify, adapt, translate, or create derivative works based on the Program
Reverse engineer, decompile, or disassemble any part of the Program
Commercialise the Program or any part of it in any way
Use the MyPersonalities® name, trademark, logo, or any associated branding without our prior written consent
Remove, alter, or obscure any copyright, trademark, or other proprietary notices in or on the Program

Your licence to use the Program is personal and non-transferable. You may not sublicense, assign, or transfer your rights under these Terms of Use to any other person.

8. Third-Party Services and Links

The Program may link to or integrate with third-party websites, applications, or services. These may include Stripe for payment processing, and other services from time to time. We have no control over, and assume no responsibility for, the content, privacy policies, terms of use, or practices of any third-party services.

By using the Program, you acknowledge that we are not responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any third-party services.

We encourage you to read the terms of use and privacy policies of any third-party services you access through the Program.

9. Disclaimer of Warranties

To the maximum extent permitted by Australian law, the MyPersonalities® Program is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that:

The Program will be uninterrupted, error-free, or completely secure
Any defects in the Program will be corrected
The Program or the servers that make it available are free of viruses or other harmful components
The results obtained from use of the Program will meet your expectations or requirements

You must take your own precautions to ensure that whatever you use to access the Program is free from viruses, malware, or anything else that may interfere with or damage your device or systems.

10. Limitation of Liability

To the extent permitted by law:

We will not be liable to you or anyone else for any loss or damage — whether direct, indirect, consequential, or economic — which may arise in connection with your use of the Program
We are not liable for any loss or damage arising from your failure to comply with these Terms of Use or our Disclaimer
We are not liable if interference with or damage to your computer systems occurs in connection with your use of the Program
We are not liable for any decisions or actions you take based on content within the Program
Our total liability to you for any claim arising out of or in connection with your use of the Program shall not exceed the total subscription fees paid by you in the three months preceding the claim

Nothing in these Terms of Use excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by Australian Consumer Law that cannot lawfully be excluded or limited.

11. Testimonials

Testimonials appearing in connection with the MyPersonalities® Program are based on the individual experiences of those who have used the Program and are unique to those individuals. We do not claim that the results described in testimonials are typical, or that they are representative of what another user may experience as a result of using the Program. Individual results will vary.

12. Changes to the Program

We reserve the right to modify, update, suspend, or discontinue any part of the MyPersonalities® Program at any time without notice. We are not liable to you or anyone else if errors occur in the information provided, or if the Program is unavailable at any time or for any period.

We may, from time to time, change or add to the Program without notice. We do not undertake to continuously keep the Program updated.

13. Changes to These Terms of Use

We reserve the right to update or amend these Terms of Use at any time. When we do, we will update the "Last updated" date at the top of this page. If we make material changes, we will notify you by email or by placing a prominent notice on our website before the changes take effect.

Your continued use of the Program after notification of changes constitutes your acceptance of the updated Terms of Use. If you do not agree with the updated terms, you must stop using the Program.

14. Governing Law

These Terms of Use are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland for the resolution of any dispute arising out of or in connection with these Terms of Use or your use of the Program.

15. Severability

If any provision of these Terms of Use is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from the remaining provisions and shall not affect their validity or enforceability.

16. Entire Agreement

These Terms of Use, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Persona Role Dynamics Pty Limited with respect to your use of the MyPersonalities® Program and supersede all prior agreements, understandings, and representations relating to the same subject matter.
